Our Terms and Conditions

1. Our Agreement with you

We are BillBuddy Limited ("BillBuddy", “we”, “us” or “our”). Our company details are set out at the end of this document. These Terms and Conditions form an agreement (“Agreement”) between us and you (“you”, “yourself”, “User” or “Customer”). The Agreement sets forth the terms and conditions of your use of any BillBuddy services you subscribe to, which include, but are not limited to, the following:
  1. Switch Service; and
  2. Comparison Service (collectively, the "Services")
Further details of our Services are set out in Section 3. By accessing, using, registering for or receiving any of the Services via our website, you are agreeing to the Terms and Conditions and our Privacy Policy. We do not charge you for our Services. Instead, we receive fees from suppliers and third parties. Please note: our website does not provide financial or investment advice, nor do we recommend particular products or services. Switch Service Where we switch you onto a new energy tariff, you will enter into a separate contract with the energy supplier and their terms and conditions and privacy policy will also apply. Comparison Service If you proceed and accept a quote from a third party provider after you use our Comparison Service, separate terms and conditions will also apply between you and the third party. We may modify this Agreement and our Privacy Policy. from time to time to reflect changes in, or requirements of, the law or modifications or updates to the Services. We will notify you if such a change materially affects your rights under this Agreement. You can always find the most up-to-date Terms and Conditions and Privacy Policy. on our website and it is your responsibility to check the current Terms and Conditions and Privacy Policy. before Subscribing to our Services. If you do not agree to be bound by this Agreement, our Privacy Policy or any subsequent modifications, you must stop using the Services.

2. Governing Law and Arbitration

The Agreement and any non-contractual obligations arising out of, or in relation to it, is governed by and construed in accordance with the laws of England and Wales. You and we irrevocably agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Agreement or its subject matter or formation.

3. Eligibility, Registration and Account Security

The Services are intended solely for users who are residents of the United Kingdom and who are eighteen (18) years of age or older. If you are not resident in the United Kingdom or you are under eighteen (18) years of age and register to use the Services or access the Services, we do not agree to provide the Services to you and you must cancel your account and stop using the Services. By registering for or using the Services, you represent and warrant that you are a United Kingdom resident and at least eighteen (18) years of age. If you are registering for and using the Services on behalf of another party, you warrant and represent that you have their express consent and that you have authority to act on their behalf with respect to any actions you take in connection with the Services. You agree to provide accurate and complete information when you register for the Services and you agree to keep such information accurate and complete during the entire time that you use the Services. We do not verify your information, meaning we are completely reliant on the information you provide to us. You are solely responsible for maintaining the confidentiality of your account details and password. You must not disclose these to anyone else. We have the right to disable your account if, in our reasonable opinion, you have failed to comply with our Terms and Conditions.

4. Services

Switch Service
We provide an energy switching service where we automatically switch your energy supplier or tariff on your behalf (Switch Service) if we believe we can obtain a better deal for you. We normally do this for you automatically every 12 months but we may also offer to switch your energy supplier or tariff as and when we determine we can obtain a cheaper deal on your behalf. Whilst we have commercial partnerships with certain energy suppliers, we are not appointed representatives or agents for any energy supplier. We act completely independently when choosing which energy suppliers to present to you, or when switching your supplier or tariff. During the process of finding you a great deal, we take many factors into account. These include (amongst other things) the financial stability of the supplier, the length of the deals on offer and, of course, price. Whilst price is a key factor in our criteria when selecting the best option for you, the offers we present to you may not be the cheapest on the market at any given time. You acknowledge that: By using our Switch Service, you appoint us as your agent to act on your behalf. This means you expressly authorise us to: You acknowledge we are not responsible for the separate contract between you and the new energy supplier and you should also carefully read and accept their terms and conditions. You acknowledge that you maintain sole responsibility for paying your energy supplier in accordance with their terms and conditions. We have no responsibility whatsoever with regards to payments between you and your energy supplier. You are solely responsible for all other aspects of your energy contract, including but not limited to providing meter readings, informing your supplier of any changes affecting your contract, concluding your energy supply contract and any other matters relating to your contract.
(b) Comparison Service
Our Comparison Service enables you to compare prices and deals across a range of products and services across different industries. We only use reputable third parties to provide you with quotes and comparisons. We do not recommend or endorse any products or services and we are reliant on the information you give us in order to formulate the quote. All information provided by us via our website is on an “as is” basis and we make no representation or warranty otherwise than is expressly set out in our Terms and Conditions. You understand and acknowledge that we do not provide financial or investment advice. More information about our particular service offerings is set out below. Insurance Our insurance comparison service enables you to compare a number of prices and deals across different insurance products and services (including home, life, health, mortgage and car insurance) (Insurance Comparison Service). In order to proceed with an insurance quote, you must contact the insurance provider directly. We will provide you with a direct link to their website and / or a phone number to call. In some circumstances we may arrange for the third party provider to contact you directly. You must ensure that you read the insurance provider’s terms and conditions and privacy policy carefully before agreeing to purchase a product or service. Those terms and conditions under which you agree to buy their product or service are completely separate to our own. We cannot accept any liability for any loss or damage incurred by you under any agreement with a third party. Household Our household comparison service enables you to compare a number of prices and deals across different household products and services (including broadband, mobile and cable services) (Household Comparison Service). In order to proceed with a quote, you must contact the provider directly. We will provide you with a direct link to their website and / or a phone number to call. You must ensure that you read the provider’s terms and conditions and privacy policy carefully before agreeing to purchase a product or service. Those terms and conditions under which you agree to buy their product or service are completely separate to our own. We cannot accept any liability for any loss or damage incurred by you under any agreement with a third party.

4. Cancellation / Termination

As long as you comply with your obligations under our Terms and Conditions, your subscription will continue with BillBuddy. We reserve the right to terminate the subscription at any time by written notice if you are in breach of our Terms and Conditions. Should you wish you terminate your relationship with us at any time, you can do so by contacting us at support@billbuddy.co.uk. Before we automatically switch you to a different energy provider, we may contact you with additional potential switches explaining the new subscription terms, along with an option to take the cheaper deal in the meantime. If you independently of us switch energy supplier outside of the scope of the Service, we may treat that as a notice by you to terminate your subscription for the Service.

5. Cooling-off Period

You are entitled to cancel your energy switch with the energy supplier within 14 days, and you do not have to provide a reason for doing so in this cooling-off period. We will endeavour to make this cancellation on your behalf. If for any reason we are unable to do so, it is your responsibility to notify the supplier and us of your decision. In order to exercise your cooling-off right, please email us at support@billbuddy.co.uk and tell us to cancel your subscription. You must complete this request within the 14 day cooling-off period in order to meet the cancellation deadline. If you wish to cancel an insurance or household product or service, you should contact the third party provider directly. We are not responsible for doing this on your behalf.

6. Intellectual Property

All trademarks, service marks or other similar items utilised by the Services are the property of their respective owners, including, without limitation, BillBuddy Limited. The ownership of all intellectual property rights relating to the Services shall remain with BillBuddy Limited, its licensors or partners. You agree not to take any action to jeopardise, limit, or interfere in any manner with any of our or a third party’s intellectual property rights.

7. Limited Warranty

We will provide the Services using reasonable care and skill. Except as expressly provided in this agreement or by law, BillBuddy and our affiliates, employees, agents, and licensors disclaim all warranties of any kind for the services provided hereunder.

8. Disclaimer and Indemnity

You acknowledge and agree that any use of the Services, including any information or content obtained through the Service, is at your own risk, subject to our limited warranty in Section 8. You further acknowledge and agree that BillBuddy exercises no control over, and accepts no responsibility for, the content of the information as it passes through network hubs and points of presence or the Internet, other than on BillBuddy controlled equipment. You agree to indemnify, defend and hold harmless: (i) BillBuddy, our officers, directors, employees, agents, licensors, suppliers and (ii) any third party providers of information or services to us and each of their respective employees, agents, subcontractors, affiliates and contractors (“Indemnitees”), from and against all losses, expenses, damages and costs, including reasonable legal fees, resulting from any violation of our Terms and Conditions or your violation of any applicable laws, rules or regulations.

9. Limitation of Liability

BillBuddy’s liability to you is not limited or excluded (a) where and to the extent such liability cannot be limited or excluded in accordance with applicable law and (b) to the extent that such loss arises from BillBuddy’s failure to provide the services using reasonable care and skill. In all other circumstances, BillBuddy or its directors, employees, agents, contractors, distributors or suppliers will not be liable to you or to any third party for any lost profits, interruption of business, or any special, indirect, incidental, exemplary, punitive, or consequential damages of any kind arising out of (i) interruption to or unavailability of the Services; (ii) bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Services by any third party; (iii) any errors or omissions in any content and/or (iv) the disclosure of information pursuant to this agreement or Privacy Policy, and BillBuddy’s liability to you or any third party claiming through you, for any cause whatsoever, and regardless of the form of the action, is limited to £500. The terms of this paragraph shall survive any termination of this Agreement.

10. Notices

Notices relating to your Services and the terms of this Agreement will be provided to you via the email address you have registered for your BillBuddy account. It is your responsibility to ensure that the personal details BillBuddy holds for you are current at all times.

11. Entire Agreement

This Agreement (including any relevant information on our website about our Services), constitutes the entire agreement between BillBuddy and you regarding the Services, and supersedes all prior agreements between you and BillBuddy regarding the subject matters hereof. Should there be any conflict in terms between this Agreement and any other document, the terms set forth in this Agreement will always prevail. Any references that are singular or plural and any references that are masculine, feminine, or neutral in gender, are meant to be used interchangeably as the context of the sentence might imply.

13. Severability

This Agreement will be enforced to the fullest extent permitted by applicable law. If for any reason any provision of this Agreement is held to be invalid or unenforceable under applicable law to any extent, then (i) such provision will be interpreted, construed, or reformed to the extent reasonably required to render it valid, enforceable, and consistent with the original intent underlying such provision and (ii) such invalidity or unenforceability will not affect the validity or enforceability of any other provision of this Agreement and all such provisions shall remain in full force and effect.

14. No Waiver

BillBuddy reserves its right to take all legal steps available to enforce this Agreement. BillBuddy’s failure to exercise any right or remedy hereunder shall not operate as a present or future waiver of such provision or of BillBuddy’s rights to enforce such right or remedy in the future. No waiver of any provisions of this or any other Agreement with BillBuddy shall be effective unless expressly stated in writing and signed by both parties.
